Noma Terms of Service
Effective Date: July 1, 2026

1. Overview; Parties; Contract Formation
   These Terms of Service (Terms) are a binding agreement between you and Tash-had Saqif, an individual doing business as Noma (Noma, we, us, or our). They govern your access to and use of the Noma iOS application, listed as "Noma - for digital nomads" in the App Store, the website at trynoma.co, and related content, features, and services (collectively, the Service).
   By accessing or using the Service, creating an account, starting a trial, buying a subscription, or tapping to accept these Terms, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
   We make the Service available only where permitted by law and platform rules. You are responsible for complying with laws that apply to you. If you use the Service on behalf of an entity, you represent that you are authorized to bind that entity, and "you" includes that entity.

2. Description of the Service
   Noma helps digital nomads and remote workers discover destinations, compare remote-work tradeoffs, plan work-friendly trips, and manage time-zone logistics. Features may include:
   - Sign in with Apple and account-based access;
   - onboarding with your name and five preference questions to determine a Nomad Archetype;
   - a World View/globe with curated destination filters such as For You, Trending, Timezone Friendly, Value, Off-Peak Season, Strong WiFi, Good Weather, English Friendly, Walkability, Beaches, Mountains, and Nightlife;
   - destination detail pages with information such as cost of living, Wi-Fi/remote-work suitability, safety and housing summaries, neighborhoods, recommended months, activities, weather, and temperature;
   - visited-country tracking;
   - trip-planning tools that collect destination, dates or flexible duration, travel party, trip pace, work mode, work hours, work time zone, work environment, neighborhood preference, weekend side-trip preference, and activity preferences;
   - AI-assisted itinerary generation, itinerary cover images, schedule summaries, maps, neighborhood suggestions, and day-by-day plans;
   - a time-zone schedule planner for comparing work and destination cities and saving time blocks;
   - settings, feedback submission, and subscription/paywall features.
   We may update, change, suspend, limit, or remove any feature at any time, including free access, trial availability, paywall rules, destination data, generated content, or provider integrations.
   The Service uses third-party technologies and providers, which may include Apple (App Store, In-App Purchase, Sign in with Apple, MapKit, WeatherKit, App Attest, DeviceCheck), Firebase/Google Cloud (Authentication, Firestore, Storage, Remote Config, App Check, Analytics), RevenueCat (subscription management), OpenAI or similar AI providers (itinerary and image generation), and Google Analytics for the website. Third-party services are governed by their own terms and privacy policies.

3. Accounts; Eligibility; Accuracy
   You must sign in, currently through Sign in with Apple, to use most app features. Keep your device and account credentials secure. You are responsible for activity under your account and for information you submit.
   You must be at least 13 years old and legally able to enter into these Terms. If you are under the age of majority in your jurisdiction, you may use the Service only with permission and supervision from a parent or legal guardian who agrees to these Terms.
   You agree to provide accurate information and to update it when necessary. We may suspend or terminate access if we believe information is inaccurate, your use creates risk, or you violate these Terms.

4. Subscriptions; Trials; Billing; Taxes
   4.1 Paid Features. Some or all app features may require an active paid subscription. Subscriptions are offered through Apple In-App Purchase and managed with RevenueCat. Available plans, prices, trial terms, renewal periods, and eligibility are shown in the App Store purchase flow, which controls if it conflicts with marketing text.
   4.2 Auto-Renewal. Subscriptions automatically renew unless canceled at least 24 hours before the current period ends. Manage or cancel subscriptions in your Apple ID settings. Deleting the app does not cancel a subscription.
   4.3 Trials and Promotions. We may offer free trials or promotions, and we may change, pause, or stop them at any time. If you do not cancel before a trial ends, your subscription converts to a paid subscription under the terms shown at purchase.
   4.4 Billing and Refunds. Apple handles billing, payment information, taxes collected through the App Store, cancellations, and refunds under Apple's policies. We do not receive your full payment card details. You are responsible for any taxes, carrier charges, data charges, and fees not collected by Apple.
   4.5 Access Changes. We may change subscription features, free access, trial availability, or pricing prospectively, subject to App Store rules and applicable law.

5. License; Use Restrictions
   5.1 License. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app on Apple-branded devices you own or control, solely for your personal, non-commercial use, in accordance with these Terms and the Apple App Store Terms of Service.
   5.2 Restrictions. You must not: (a) copy, modify, translate, sell, resell, lease, rent, sublicense, distribute, or create derivative works of the Service except as expressly allowed by law; (b) reverse engineer, decompile, disassemble, or attempt to derive source code, models, prompts, keys, or non-public APIs except where such restrictions are prohibited by law; (c) access the Service to build, train, benchmark, or improve a competing product or model; (d) scrape, crawl, harvest, bulk download, or automate access without written permission; (e) bypass, disable, or interfere with security, authentication, paywall, App Check, rate limits, or access controls; (f) upload malware or interfere with the Service; (g) use the Service for unlawful, harmful, fraudulent, harassing, defamatory, obscene, infringing, deceptive, or unsafe purposes; (h) submit content you do not have the right to submit; or (i) use the Service in violation of export, sanctions, privacy, consumer protection, or platform rules.

6. User Content; Feedback
   6.1 Your Content. You may submit information, preferences, feedback, locations, time blocks, itinerary inputs, activity preferences, and other content (User Content). You retain ownership of your User Content.
   6.2 License to Operate the Service. You grant Noma a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, transmit, display, adapt, create derivative works from, and otherwise use your User Content as needed to operate, provide, maintain, secure, support, improve, and develop the Service, including by sending relevant content to service providers and AI providers. This license continues for as long as needed for those purposes, including backup, legal, security, and audit purposes.
   6.3 Responsibility. You are solely responsible for your User Content and your decisions based on the Service. Do not submit sensitive personal information, secrets, medical information, immigration documents, financial account details, government identifiers, or personal data about other people unless you have the right and authority to do so.
   6.4 Feedback. If you submit ideas, bug reports, suggestions, or other feedback, you grant Noma a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without restriction or compensation.

7. AI-Generated and Informational Content
   The Service may use AI systems, including OpenAI or similar providers, to generate itineraries, summaries, maps-related content, destination descriptions, schedule suggestions, images, and other outputs. AI outputs can be inaccurate, incomplete, duplicated, offensive, unsafe, or outdated. Similar or identical outputs may be generated for other users.
   Outputs are provided for informational and planning purposes only. They are not professional travel, safety, immigration, legal, medical, financial, tax, insurance, or security advice. You must independently verify critical information, including visas, entry rules, local laws, safety conditions, health guidance, accessibility, weather, transportation, opening hours, prices, neighborhood conditions, and booking terms.
   We do not guarantee that any output, destination, route, activity, venue, accommodation, neighborhood, travel date, weather summary, or recommendation is accurate, available, legal, safe, suitable, or current.

8. Travel Risks; No Bookings; No Agency
   Travel involves inherent risks, including injury, illness, theft, crime, civil unrest, weather events, transportation disruption, property loss, visa or entry denial, and other harms. You assume all risks arising from your travel choices, itinerary choices, activities, and interactions.
   Noma is not a travel agency, tour operator, transportation provider, accommodation provider, insurer, immigration advisor, safety advisor, marketplace, broker, fiduciary, or agent for you or any third party. Unless we expressly state otherwise in writing, we do not book, sell, endorse, inspect, control, verify, or guarantee third-party destinations, venues, accommodations, transportation, events, activities, service providers, or listings.
   Your dealings with third parties are solely between you and the third party. We are not responsible for third-party acts, omissions, prices, refunds, cancellations, injuries, losses, data practices, terms, or content.

9. Destination, Safety, Weather, and Cost Information
   Destination information, safety summaries, cost estimates, Wi-Fi or remote-work scores, housing summaries, neighborhood suggestions, recommended months, weather information, time-zone comparisons, activities, and other travel content are general informational materials. Conditions can change quickly and may vary based on your circumstances, local laws, current events, seasonality, weather, health, accessibility, transportation, crime, and other factors outside our control.
   You are solely responsible for checking current official advisories, local sources, provider terms, and other reliable information before making travel or safety decisions.

10. Location, Notifications, and Device Features
   If you grant permission, the app may use foreground location while you are using the app to infer your current city or time zone for destination filtering and time-zone features. You may also choose locations through search. You can control location permissions in iOS Settings.
   If you grant permission, the app may send local notifications, such as itinerary completion reminders. You can control notifications in iOS Settings.
   Some features may be limited, unavailable, or less accurate if location, notifications, network access, or other device permissions are disabled.

11. Third-Party Services and Links
   The Service may reference or integrate third-party sites, services, content, SDKs, APIs, or platforms, including Apple, Firebase/Google Cloud, RevenueCat, OpenAI, Google Analytics, MapKit, WeatherKit, and other providers. We do not control and are not responsible for third-party services. Your use of third-party services is governed by their terms and privacy policies.
   Links or references do not imply endorsement, warranty, or responsibility.

12. Ownership; Intellectual Property
   The Service, including software, designs, text, images, destination data, prompts, workflows, trademarks, logos, trade dress, and other content, is owned by Noma or its licensors and is protected by law. Except for the limited license in Section 5, no rights are granted to you.
   You may not remove, obscure, or alter proprietary notices, use Noma branding without permission, or imply affiliation, endorsement, or sponsorship without written consent.

13. Term; Suspension; Termination
   These Terms remain effective until terminated. You may stop using the Service at any time. We may suspend, limit, or terminate your access, with or without notice, if we believe you violated these Terms, your use creates risk, required providers or platforms become unavailable, we discontinue the Service, or we need to protect Noma, users, third parties, or the public.
   Termination does not automatically cancel App Store subscriptions; you must cancel through Apple ID settings. Sections that by their nature should survive will survive, including Sections 5.2, 6-9, 11-23.

14. Warranty Disclaimers
   TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, FEATURES, OUTPUTS, DATA, AND THIRD-PARTY INTEGRATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. NOMA, TASH-HAD SAQIF, AND THEIR SERVICE PROVIDERS, LICENSORS, CONTRACTORS, AGENTS, AND REPRESENTATIVES (COLLECTIVELY, THE NOMA PARTIES) DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, QUIET ENJOYMENT, AND NON-INTERRUPTION.
   THE NOMA PARTIES DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, CURRENT, COMPLETE, OR FREE FROM HARMFUL COMPONENTS, OR THAT ANY OUTPUTS, DESTINATION INFORMATION, WEATHER INFORMATION, MAP DATA, COST ESTIMATES, SUBSCRIPTION STATUS, OR GENERATED CONTENT WILL BE ACCURATE OR RELIABLE.

15. Limitation of Liability; Allocation of Risk
   TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE NOMA PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES; LOST PROFITS; LOST REVENUE; LOSS OF DATA; LOSS OF GOODWILL; BUSINESS INTERRUPTION; PERSONAL INJURY; PROPERTY DAMAGE; TRAVEL LOSSES; COSTS OF SUBSTITUTE SERVICES; OR DAMAGES ARISING FROM AI OUTPUTS, THIRD-PARTY SERVICES, TRAVEL DECISIONS, SAFETY INFORMATION, SUBSCRIPTION ISSUES, OR UNAUTHORIZED ACCESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
   TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE NOMA PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE THROUGH THE APP STORE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
   SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS OR LIMITATIONS. IN THOSE JURISDICTIONS, THE NOMA PARTIES' LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

16. Indemnification
   To the maximum extent permitted by law, you will defend, indemnify, and hold harmless the Noma Parties from and against any claims, demands, actions, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use or misuse of the Service; (b) your User Content; (c) your travel decisions, activities, bookings, or interactions; (d) your violation of these Terms or applicable law; (e) your violation of third-party rights; or (f) your dispute with any third party.

17. App Store Terms; Apple as Third-Party Beneficiary
   These Terms are between you and Noma, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support. Your use of the app must comply with the Apple App Store Terms of Service and applicable Apple rules. To the extent any warranty applies that cannot be disclaimed, Apple may refund the purchase price, if any, as required by applicable Apple terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Export; Sanctions; Compliance
   You must comply with all applicable export control, sanctions, anti-corruption, consumer protection, privacy, and other laws. You may not use or access the Service if you are barred from doing so under applicable law or if doing so would cause Noma or any provider to violate applicable law.

19. Dispute Resolution; Arbitration; Class Action Waiver
   Please read this section carefully. It affects your rights.
   19.1 Informal Resolution. Before filing a claim, you agree to email contact@trynoma.co with a brief description of the dispute and your contact information so we can try to resolve it informally within 30 days.
   19.2 Arbitration Agreement. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration agreement.
   19.3 Location and Procedure. The seat and venue of arbitration will be New York County, New York, USA, unless the applicable rules or law require otherwise. Proceedings may be conducted by documents, phone, video, or in person at the arbitrator's discretion. The language is English. Each party pays its own fees and costs except as the rules or law provide otherwise.
   19.4 Individual Basis Only. You and Noma agree that disputes will be resolved only on an individual basis. Class, collective, consolidated, representative, private attorney general, and mass arbitration proceedings are not permitted to the maximum extent permitted by law. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim.
   19.5 Small Claims and Injunctive Relief. Either party may bring an individual action in small claims court with jurisdiction. Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction in New York County, New York, to preserve rights or prevent misuse pending arbitration.
   19.6 Opt-Out. You may opt out of this arbitration agreement within 30 days of your first use of the Service by emailing contact@trynoma.co with the subject "Arbitration Opt-Out" and including your name and account email. Opting out does not affect other provisions of these Terms.

20. Governing Law; Venue
   These Terms and any non-arbitrable disputes are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules, and by the Federal Arbitration Act for arbitration matters. Subject to Section 19, the exclusive venue for permitted court actions is the state and federal courts located in New York County, New York, USA, and you consent to their jurisdiction.

21. Changes to the Service or Terms
   We may modify the Service or these Terms at any time. If we make material changes, we will provide reasonable notice, such as by posting the updated Terms, providing in-app notice, or using another appropriate method. The updated Terms are effective when posted unless stated otherwise. Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service and cancel any subscription through Apple ID settings.

22. Force Majeure
   The Noma Parties are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, government actions, platform changes, app store issues, utility failures, network outages, cyberattacks, provider outages, AI provider changes, or third-party service disruptions.

23. Miscellaneous
   These Terms, together with the Privacy Policy and any terms shown in the App Store purchase flow, are the entire agreement between you and Noma regarding the Service and supersede prior agreements on that subject.
   If any provision is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver.
   You may not assign or transfer these Terms without prior written consent. We may assign or transfer these Terms without restriction, including in connection with a reorganization, merger, acquisition, sale of assets, change of operator, or formation of a business entity to operate the Service.
   We may provide notices by email, in-app notice, website posting, App Store notice, or other reasonable means. You consent to electronic communications.
